​Port of Brookings Harbor Public Wi-Fi Network End User Terms and Conditions of Use

Use of this Wi-Fi network constitutes consent to monitoring, retrieval, and disclosure by authorized personnel, and the user acknowledges that he/she is subject to, and agrees to abide by, all laws, rules, and regulations of the federal government that are applicable to Internet use. Inappropriate use may subject violators to criminal, civil and/or disciplinary action. USERS HAVE NO REASONABLE EXPECTATION OF PRIVACY IN THE USE OF THIS SYSTEM.
1. Acceptance of Terms and Conditions (T&C's) by Use: Your electronic acceptance and use of the Port of Brookings Harbor Public Wi-Fi constitutes your acceptance of the T&C's. Your electronic acceptance of the T&C's shall have the same force and effect as if you had actually signed the T&C's.
2. Wi-Fi Network Availability: Actual Wi-Fi Network wireless access, coverage, speeds, locations and quality may vary. The Wi-Fi Network is subject to unavailability, including emergencies, third party service failures, transmission, equipment or network problems or limitations, interference, signal strength, and maintenance and repair, and may be interrupted, refused, limited or curtailed. The Port of Brookings Harbor is not responsible for data, messages or pages lost, not delivered, delayed or misdirected because of interruptions or performance issues with the Wi-Fi Network or communications services or networks. The Port of Brookings Harbor may impose usage limits, suspend access, or block certain kinds of usage in our sole discretion to protect this public Wi-Fi Network. The accuracy and timeliness of data transmitted or received is not guaranteed; delays or omissions may occur.
3. Use of Wi-Fi Network: All USERS are expected to use the wireless access in a legal and responsible manner. While using this wireless access, users should not violate Federal, State, or local laws, including those relating to:
  • The transmission or receiving of any pornography or harmful material - Accessing or displaying obscene language or sexually explicit graphics or materials is prohibited.
  • Fraud – All users are prohibited from misrepresenting themselves as another user, attempting to modify or gain access to files, passwords, or data belonging to others, seeking unauthorized access to any computer system, or damaging or altering software components of any network or database.
  • Downloading copyrighted material - U.S. copyright law prohibits the unauthorized reproduction or distribution of copyrighted materials, except as permitted by the principles of "fair use." No user may copy or distribute electronic materials without the explicit permission of the copyright holder.
  • Transmit Data - (a) transmit data or materials that contain viruses and/or code designed to interrupt services, destroy, or limit the use of computer equipment, software, or telecommunications equipment; (b) transmit data or materials that infringe on the copyright, trademark or intellectual property of others; (c) transmit data or materials that are harassing, defamatory, obscene, or attacking the race, ethnicity, sexual orientation, or physical attributes of any person; (d) use equipment and services for excessive transfer of data; (e) impersonate any person, entity, or misrepresent your affiliation with any person or entity for any purpose; or (f) conduct any activities that are criminal in nature.        
Use of the Wi-Fi Network to access any inappropriate, offensive or disturbing material may result in a permanent ban on future access to the Wi-Fi Network.
4. This network provides data services such as Internet access to the general public in publicly accessible areas using personally owned devices such as cell phones, tablets, and laptops. No official government or business activity is to occur on this network. No government furnished equipment (GFE) shall be connected to this network. This network cannot be used to store, process, or transmit government data. Use of this Wi-Fi Network by GFE may result in a permanent ban on future access to this Wi-Fi Network for those devices.
5. Disclaimer of Warranties: THE WI-FI NETWORK IS PROVIDED ON AN "AS IS" AND "WITH ALL FAULTS" BASIS, AND WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING, BUT NOT LIMITED TO, WARRANTIES OF TITLE, MERCHANTABILITY, NON-INFRINGEMENT, OR FITNESS FOR A PARTICULAR PURPOSE WHICH ARE EXPRESSLY DISCLAIMED. YOU ASSUME ALL RESPONSIBILITY AND RISK FOR USE OF THE WI-FI NETWORK.
6. Limitation of Liability: The Port of Brookings Harbor shall not be liable for any deficiency in performance caused in whole or in part by the act or omission of the Wi-Fi Network, an underlying carrier or service provider, equipment or facility failure, network problems, interference, lack of coverage or network capacity, acts of God, strikes, fire, war, terrorism, riot, emergency, government actions or any other cause beyond our control. Port of Brookings Harbor  shall not be liable for any damage, privacy violation, etc. to the user's equipment that could occur while using this Wi-Fi Network.
7. Privacy and Security: Wireless systems use radio channels to transmit voice and data communications over a complex network. Privacy cannot be guaranteed, and Port of Brookings Harbor is not liable to you or any other party for any lack of privacy you experience while using the Wi-Fi Network. If you use the Wi-Fi Network, you understand that others may be able to see and observe your use of the Wi-Fi Network. You understand that the wireless technology is not inherently secure and that wireless communications can be intercepted by technology designed and intended for that purpose. You agree that you are responsible for providing security measures that are suited for your intended use of this Wi-Fi Network. For example, you shall take full responsibility for taking adequate measures to safeguard your data from loss. Data is collected in the form of logs for maintenance purposes, performance, and system security requirements. The Port will provide this information, without notification to the user, upon request by law enforcement in aiding investigation of criminal activity or civil disputes or in situations where the Port is acting in good faith to prevent harm to others or violations of the law.  
8. The Port of Brookings Harbor is not liable for any damage, undesired resource usage, or detrimental effects that may occur to a user's device and/or software while the user’s device is attached to the network. The user is responsible for any actions taken from their device, whether intentional or unintentional, that damage or otherwise affect other devices or users of the Wi-Fi Network. The user hereby releases the Port of Brookings Harbor from liability for any loss, damage, security infringement, or injury which the user may sustain as a result of being allowed access to the Wi-Fi Network. The user agrees to be solely responsible for any such loss, infringement, damage, or injury. 
9. Severability: All terms and provisions of these T&C's are independent of each other. If any term or provision of these T&C's is held to be inapplicable or unenforceable such term or provision shall be construed to reflect the intentions of the Port of Brookings Harbor’s with the other provisions remaining in full force and effect unless the Port of Brookings Harbor obligations hereunder are materially impaired, in which event the Port of Brookings Harbor reserves the right to terminate the T&C's and the Wi-Fi Network.
10. Entire Agreement and Applicable Law: The T&C's represents the final and entire agreement between users and the Port of Brookings Harbor regarding the Wi-Fi Network. You represent that you are of legal age and have the legal capacity to agree to the T&C's. The T&C's are governed by the laws of the United States, foreign laws do not apply.

The letter must contain the complainant’s name, address, telephone number, and a written description of the alleged discriminatory action in sufficient detail to inform the Assistant Secretary for Civil Rights (ASCR) about the nature and date of an alleged civil rights violation. The completed AD-3027 form or letter must be submitted to USDA by:
